These Terms of Use (“Terms”) govern access to and use of the Nativora System platform
(the “Platform”) operated by Antara Arceneaux (“Nativora”,
“we”, “us”). By creating an account or using the Platform, you agree to these
Terms. If you do not agree, do not use the Platform.
1. Definitions
- School — an academy or driving school with its own workspace on the Platform.
- School Administrator — a person authorised to manage a School’s courses, staff, learners, and billing.
- Instructor — a person assigned by a School to teach courses and conduct classes.
- Student — a learner enrolled, or applying to enrol, in a School’s course.
- Content — courses, chapters, lessons, videos, quizzes, assignments, documents, messages, and files on the Platform.
2. Accounts and eligibility
- You must provide accurate registration details and keep them current. Email verification may be required before access is granted.
- You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly of any suspected unauthorised use.
- Accounts are personal. Do not share credentials or let another person use your account.
- If you are under the age of majority where you live, you may use the Platform only with the consent and supervision of a parent or guardian, arranged through your School.
- Instructor and School Administrator accounts are created by a School or by Nativora. Those accounts carry access to other people’s personal data and must be used only for legitimate School business.
3. Roles and responsibilities
The Platform is software. The education, instruction, assessment, and any certification are provided
by the School, not by Nativora.
- Schools are responsible for the accuracy and legality of the Content they publish, the fees they set, the learners they admit, the records they keep, and for complying with the education, licensing, consumer-protection, and data-protection laws that apply to them.
- Instructors are responsible for conducting classes, marking attendance accurately, and grading fairly.
- Students are responsible for their own submissions, for attending classes they enrol in, and for the accuracy of information they provide.
- Nativora is responsible for operating the Platform in accordance with these Terms.
4. Enrolment and course access
Enrolment follows a fixed sequence, and access is granted only at the end of it:
- A Student applies to enrol in a course.
- A School Administrator approves or declines the application. Approval alone does not unlock content.
- The applicable fees are paid.
- Course access is granted, and the Student is assigned to the School.
Access may be time-limited where a School sets a course duration; an enrolment may expire at the end
of that period. A School may withdraw access where a Student breaches these Terms or the
School’s own rules.
5. Fees, payments, and refunds
- Fees are set by the School, displayed before payment, and may include an enrolment fee, tuition, or an instalment plan.
- Payments are processed by Stripe. Card details are entered directly with Stripe and are never stored by Nativora.
- Student fees are collected on behalf of the School and settled to the School’s own connected payment account. Nativora is not the merchant of record for those fees.
- Where an instalment plan applies, you authorise the scheduled charges. Failed instalments may suspend course access until resolved.
Refunds are the School’s responsibility. Refund eligibility, cancellation
windows, and any pro-rating are set by the School’s own policy. Direct refund requests to
your School. Nativora does not issue refunds for fees collected on a School’s behalf and
cannot override a School’s refund decision.
6. School subscriptions
- A School subscribes to the Platform on a monthly or annual cycle and authorises recurring charges until cancelled.
- A subscription renews automatically at the end of each period unless cancelled beforehand. Cancellation takes effect at the end of the current period.
- If a subscription lapses, School Administrator access to management features may be restricted until payment is brought up to date. Learners already enrolled are not immediately cut off from content they have paid for.
- A School must also complete payment-account onboarding before it can be listed publicly and accept new learner sign-ups.
7. Live and on-site classes
- Live classes are hosted on Zoom using the assigned instructor’s connected Zoom account. Your use of Zoom is additionally governed by Zoom’s own terms.
- On-site classes take place at the venue the School specifies.
- Schedules may change. Schools are responsible for notifying learners of changes, cancellations, and substitutions.
- Recording, capturing, or redistributing a class — by screen capture or any other means — without the instructor’s and participants’ consent is prohibited.
- Host credentials for a live class are issued only to the assigned instructor and must not be shared.
8. Attendance records
- Attendance may be marked manually by an instructor, by a Student scanning a short-lived QR code at an on-site class, or derived automatically from Zoom participation at a live class.
- Attendance may affect course completion, certification, or eligibility under a School’s rules or applicable regulation.
- Attempting to falsify attendance — including sharing a QR code, marking attendance for another person, or joining a live class under another person’s account — is a serious breach of these Terms and may result in immediate termination.
- If you believe an attendance record is wrong, raise it with your instructor or School Administrator, who can correct it.
9. Acceptable use
You must not:
- break any law, or infringe anyone’s intellectual property or privacy rights;
- upload malware, or content that is unlawful, harassing, defamatory, hateful, or sexually explicit;
- attempt to access data, accounts, or Schools you are not authorised to access;
- probe, scan, or test the security of the Platform, or circumvent authentication, rate limits, or access controls;
- scrape, crawl, or bulk-extract data, or use automation to create accounts or submit activity;
- impersonate another person, or misrepresent your role or affiliation;
- resell, sublicense, or redistribute the Platform or another party’s Content without permission; or
- interfere with the operation of the Platform or place an unreasonable load on it.
10. Messaging
- Course and group chats exist for communication between a Student and their instructor about the course. Keep messages relevant and respectful.
- Instructors and School Administrators may moderate messages, including removing a message from view for all participants.
- A message you delete is hidden from you but may remain visible to your instructor and retained for the School’s moderation and record-keeping obligations.
- Do not use messaging to send unsolicited commercial content, or to share credentials or another person’s personal data.
11. Content and intellectual property
- The Platform, its software, and its design are owned by Nativora and protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Platform for its intended purpose.
- Content published by a School remains the property of that School or its licensors. Your access is for your own learning only — you may not copy, record, redistribute, or publish it.
- You retain ownership of the material you submit, such as assignments, messages, and uploaded files. You grant the School, and Nativora as its processor, the licence needed to store, display, and process that material to deliver the service.
- You must have the rights to everything you upload.
- To report alleged infringement, contact antara.apurpose@gmail.com with enough detail to identify the material and your claim.
12. Electronic signatures
A School may require you to sign policies or documents electronically. By signing, you agree that
your electronic signature has the same legal effect as a handwritten one, and that we may record the
fact, time, and account of signing as evidence. You may request a copy of anything you have signed.
13. Availability and support
- We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. Maintenance, updates, and outages may interrupt access.
- Features may be added, changed, or withdrawn as the Platform develops.
- The Platform depends on third-party services — payment processing, video conferencing, file storage, email, and push notifications. Their interruption may affect the Platform, and is outside our control.
- Support requests go to antara.apurpose@gmail.com. Students and instructors should contact their School first for anything about courses, classes, fees, or records.
14. Suspension and termination
- You may stop using the Platform at any time and may request deletion of your account.
- A School may suspend or block an account within its workspace in line with its own rules.
- We may suspend or terminate access — with notice where practical, immediately where not — for breach of these Terms, suspected fraud, non-payment, or activity that risks the security or integrity of the Platform or its users.
- On termination, your right to use the Platform ends. Records may be retained as described in the Privacy Policy and as required for a School’s academic, accounting, and legal obligations.
- Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity, and governing law — continue to apply.
15. Disclaimers
Except where the law does not allow it, the Platform is provided “as is” and
“as available”, without warranties of any kind, express or implied, including
merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant any educational outcome, qualification, certification, licence, or examination
result. Course quality, teaching, assessment, and any certification are the School’s
responsibility. Nothing on the Platform is legal, financial, or professional advice.
16. Limitation of liability
To the fullest extent permitted by law, Nativora is not liable for indirect, incidental, special,
consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from
or related to your use of the Platform.
Our total aggregate liability arising out of or relating to these Terms is limited to the greater of
the amount you paid to Nativora in the twelve months before the event giving rise to the claim, or
USD 100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited,
including for death or personal injury caused by negligence, or for fraud.
17. Indemnity
You agree to indemnify and hold harmless Nativora and its officers, employees, and agents from
claims, damages, liabilities, and reasonable legal costs arising from your breach of these Terms,
your misuse of the Platform, or your infringement of another party’s rights. A School further
indemnifies Nativora in respect of the Content it publishes and the learner relationships it manages.
18. Governing law
These Terms are governed by the laws of [Country/State], without regard to
conflict-of-law rules. The courts of [Country/State] have exclusive jurisdiction,
except that either party may seek injunctive relief in any competent court to protect its
intellectual property or confidential information. If any provision is held unenforceable, the rest
remains in force.
19. Changes to these Terms
We may update these Terms as the Platform evolves or the law changes. The “Last updated”
date above reflects the current version. For material changes we will give notice in the Platform or
by email before they take effect. Continued use after that means you accept the updated Terms.
